Copyright & AI: The Fine Line Between Human Creativity & Machine Output
The rapid growth of generative AI has challenged the long-standing legal requirements of creativity and originality for copyright protection. In response, the U.S. Copyright Office recently released a report affirming that existing copyright principles apply to AI-generated content, and only human-created works can enjoy copyright protection.
AI-generated content without meaningful human involvement does not qualify for copyright protection. Simply providing prompts to an AI system is insufficient to warrant copyright protection. However, if a human author exercises creative control — by curating, modifying, or arranging AI-generated material—the resulting work may qualify for copyright protection.
Therefore, businesses leveraging AI for content creation should carefully document human contributions to strengthen their copyright claims. Without clear documentation, AI-generated works may struggle to secure copyright protection.
